4 and August 18, 2008 the Lewistown City Commission adopted
the following ordinance:
ORDINANCE

AN ORDINANCE
CREATING A MULTI-JURISDICTIONAL SERVICE DISTRICT FOR THE PURPOSE
OF PROVIDING, SUPPORTING, AND FUNDING INCREASED LIBRARY SERVICES
IN FERGUS COUNTY; AND PROVIDING FOR A NAME FOR THE PROPOSED
DISTRICT; AND DESCRIBING THE SERVICES TO BE PROVIDED BY THE
PROPOSED DISTRICT; AND SPECIFYING THE BOUNDARIES OF SUCH DISTRICT;
AND INCLUDING A STATEMENT OF CONVENIENCE AND NECESSITY; AND
ESTIMATING THE COSTS OF PROVIDING SUCH LIBRARY SERVICES; AND
DESCRIBING THE METHOD OF FUNDING SUCH SERVICES; AND PROVIDING
ADMINISTRATION FOR THE PROPOSED DISTRICT; AND SETTING A MAXIMUM

WHEREAS,
the Lewistown City Commission has an interest in supporting
library services in Fergus County, and
WHEREAS,
the Lewistown City Commission has been made aware of written
recommendations from an ad hoc committee appointed by the Fergus
County Community Council; and
WHEREAS,
the ad hoc committee has recommended creation of a multi-jurisdictional
service district for the purpose of providing, supporting, and
funding of increased library services in Fergus County; such
multi-jurisdictional service district being authorized by Title
7, Chapter 11, Part 11, Montana Code Annotated; and
WHEREAS,
creation of a multi-jurisdictional service district must be
by passage of an ordinance by each jurisdiction wishing to be
a member or part of such district; and
WHEREAS,
Lewistown City Commission enacts the ordinance set out below
to create a multi-jurisdictional service district for the purpose
of providing, supporting, and funding of increased library services
for Fergus County.
IT IS HEREBY
ORDAINED AS FOLLOWS:
Section
1. NAME. There is hereby created a multi-jurisdictional service
district to be known and the Fergus County Library Services
Multi-jurisdictional Service District.
Section
2. SERVICES TO BE PROVIDED. The Fergus County Library Services
Multi-jurisdictional Service District shall be charged with
providing, supporting, and funding of increased library services
for Fergus County, Montana, which will more specifically be
addressed in the Inter-local Agreement to be negotiated, drafted,
and approved by the member jurisdictions.
Section
3. CONVENIENCE AND NECESSITY. The Fergus County Library Services
Multi-jurisdictional Service District will be in the best position
to study, manage, provide, and support increased library services
to the various communities in Fergus County. Due to the existing
funding mechanisms available in Fergus County for the financial
support of libraries, the Fergus County Library Services Multi-jurisdictional
Service District will be charged with allocating and mobilizing
available resources to achieve equalization of the cost of providing
such services to the residents of Fergus County.
Section
4. BOUNDARY MAP. The boundaries of the Fergus County Library
Services Multi-jurisdictional Service District shall include
all of Fergus County. The boundaries shall include all of that
territory located within the boundaries of the City of Lewistown
and the incorporated towns of Fergus County. A map of the district
is attached hereto.
Section
5. ESTIMATED COSTS AND FINANCING. The estimated cost of providing,
supporting, and funding of library services in Fergus County
is the approximate amount of $210,600.00 per year, which is
the amount of money estimated to be received based upon a property
tax levy of 13 mills. In conjunction with the passage of this
Ordinance, the City Commission is advised that the Fergus County
Commissioners have passed a resolution requesting voter approval
to increase the Fergus County mill levy to raise such funds
on an annual basis for a period of five years.
Section
6. ADMINISTRATION. The Fergus County Library Services Multi-jurisdictional
Service District shall be administered by a board of trustees
to be appointed by the Fergus County Commissioners; with all
member jurisdictions having representation. Various administrative
guidelines shall be set forth in an Inter-local Agreement to
be negotiated, drafted, and approved by the member jurisdictions;
and such administrative guidelines shall be in accordance with
the provisions of Section 22-1-305 through Section 22-1-317,
Montana Code Annotated.
Section
7. MAXIMUM PROPERTY TAX MILL LEVY. The maximum property tax
mill levy for property taxes in the district shall be thirteen
mills, each year, for a period of 5 years.
Section
8. RIGHT OF PROTEST. A right of protest is statutorily available
and recognized by the provisions of Section 7-11-1107, Montana
Code Annotated. Notice of passage of this Ordinance shall be
by posting or publication, in accordance with Section 7-1-4127,
Montana Code Annotated. Within 30 days of the publication or
posting of notice of passage of this Ordinance, electors or
property owners of the city may submit written protests to the
city clerk. If more than 50 percent of the electors, or the
owners of more than 50 percent of the taxable value of the property
in the city limits protest this Ordinance, then this Ordinance
shall be void in its entirety.
Section
9. EFFECTIVE DATE. This Ordinance, if not declared void by a
sufficient number of electors or property owners exercising
their right of protest, shall be effective 30 days after second
and final adoption, pursuant to Section 7-5-105, Montana Code
Annotated; or shall be effective 30 days after publication or
posting of notice; whichever is later.
Section
10. VOID FOR LACK OF MEMBERS. This Ordinance presumes that other
jurisdictions in Fergus County, which are named below, will
pass a similar Ordinance and elect to become members of the
Fergus County Library Services Multi-jurisdictional Service
District. The other jurisdictions are all of the other incorporated
towns in Fergus County, the City of Lewistown, and Fergus County.
If any one of these other jurisdictions chooses not to become
a member, by passage of a similar ordinance and expiration of
the protest period without sufficient protest, then this ordinance
shall become void in its entirety.
Section
11. VOID FOR LACK OF FUNDING. The funding mechanism for the
Fergus County Library Services Multi-jurisdictional Service
District, as stated in Section 5, shall be a voter approved
mill levy, to raise the approximate amount of $210,600.00 per
year, with a property tax levy of 13 mills for each year, over
a period of five years. If the voters fail to approve the special
levy at the general election scheduled for November 4, 2008,
this Ordinance shall be void in its entirety.

and effective 30 days thereafter except as otherwise provided.

IS HEREBY GIVEN that the City Commission of the City of Lewistown,
Montana, has prepared the Preliminary Budget for Fiscal Year
2008-2009, and that Public Hearings on said budget will begin
on Tuesday, September 2, 2008 at the regular Commission meeting
which starts at 7:00 p.m. and is held at the Central Montana
Community Center at 307 W Watson. The Preliminary Budget includes
the proposed use of the Citys General and Special Funds.
The entire Budget will be on file Monday, August 19, 2008 in
the office of the City Clerk at 305 W Watson in Lewistown, Montana.
Any taxpayer may appear at the Budget Hearings and be heard
for or against any part of the Preliminary budget, or may submit
